(Washington DC) – The court ruled against an appeal from the state of Idaho barring doctors from performing abortions in the case of emergencies. The court ruled 6-3 that the strict state law was in violation of a federal law that requires lifesaving care for emergency room patients, including pregnant women.
The Biden administration sued the state of Idaho over the state law saying that the Emergency Medical Treatment and Labor Act (EMTALA) takes precedence. Abortion advocates say that the language bill does not include exceptions for the health of the mother.
A document detailing the decision leaked a day before the ruling was officially released. A spokesperson for the high court says it was “inadvertently” posted to the court’s website.
