AZ 1864-era Abortion Law Has Been Overturned

House Bill 2677, the repeal of the 1864 abortion ban, passed the Senate with its 16th yes vote in the Senate Chambers in Phoenix on May 1, 2024. One day later it was signed into effect by Governor Katie Hobbs.

(Phoenix, AZ) – Arizona’s controversial Civil War-era abortion law has been overturned. It was last month when the state’s Supreme Court ruled that an 1864 law was still valid. It basically banned all abortions — except when the mom’s life is in danger. But now, it’s no longer law.

Governor Katie Hobbs signed a bill on Thursday which repeals the over 150-year-old law. That followed legislation passed by the State Senate on Wednesday — in which two Republicans joined with all Democrats to overturn the ban.

So now the state’s 2022 law is reinstated. It bans abortion after 15 weeks of pregnancy. The issue of abortion remains front and center headed into the presidential election. Florida just enacted a six-week abortion ban, joining Georgia and South Carolina in taking that step.
