How Did Hershey Win Its Halloween Candy Lawsuit?

(New York, NY) – Some people are really passionate about snacking. That’s likely doubly true for candy. And when peanut butter is involved? All bets are off.

A class action lawsuit recently went the way of the Hershey Company — specifically tied to the Reese’s peanut butter cup product. The group that filed the suit claimed Hershey had committed false advertising by selling their Halloween pumpkin-shaped peanut butter cups, with no face on the chocolate. While the candies are shaped like a pumpkin, there’s no jack-o-lantern face — despite there being one printed on the packaging. And in the lawsuit, the petitioners said that disappointed them.

Videos on social media in which people agreed with the lawsuit showed people making a comparison to the Snickers’ Halloween product — which does have a little face on the chocolate. So, the “confectionary technology does exist.” But the lawsuit was ultimately dismissed by the judge, who said there was no proof “economic injury.”

So we say, anyone who can’t eat their peanut butter cups because they don’t have a face — send them our way. They taste the same either way!
