Judge Refuses to Dismiss Charges Against Daniel Penny

(New York, NY) — A Manhattan judge says he won’t drop charges against Daniel Penny.

Penny was charged in connection to last year’s subway chokehold death. The 24-year-old Long Island marine veteran was caught on camera placing Jordan Neely in a deadly chokehold on a subway train in May of 2023.  Penny’s attorneys say he was just defending himself from Neely who was identified as a homeless man, and was allegedly acting erratically and threatening passengers. An online fund has raised nearly three million dollars to cover Penny’s legal expenses.  The trial isn’t expected to begin until fall at the earliest. Penny is due back in court in March.
