Supreme Court Blocks Wartime Act

(New York, NY) – The High Court is declaring that no more deportations can take place under the Alien Enemies Act of 1798. In an early morning ruling on Saturday, the court essentially blocked the efforts by President Trump to oust another wave of Venezuelan migrants. The 7-2 decision saw Justices Samuel Alito and Clarence Thomas dissent. In a full opinion, Alito claimed that the court order was a rushed decision without the chance to hear from lower courts. Alito called the court order “legally questionable”. In the court’s order, they say as the legal case plays out in the lower Fifth Circuit court, no detainees can be removed from the country until the Supreme Court approves.

The order follows several lawsuits from the ACLU to prevent alleged gang members in a Texas prison from being sent to a high-security prison in El Salvador. President Trump invoked the Alien Enemies Act, a war power last used during World War II, in order to deport suspected members of the Tren de Aragua gang. Last month, the White House sent over 100 Venezuelans to El Salvador, getting zero or little due process.
