(New York, NY) — There’s a trial date for the New York City Marine veteran accused in the chokehold death of a man on a subway train last May. A judge ruled this morning that Daniel Penny will stand trial on manslaughter starting October 8th. Penny’s lawyers had called for the case to be dismissed, arguing he acted in self-defense because Jordan Neely was threatening passengers but prosecutors say Penny went too far. Penny’s trial is expected to last several weeks.
