Can You Grow Pot Plants in New York?

New York is letting residents know the rules when it comes to growing your own marijuana plants at home.

(Albany, NY) – As of 2016, marijuana was made legal for medical purposes in New York State. The same became true for recreational cannabis use as of 2021. But many New Yorkers find themselves wondering: can I grow my own pot plant? State regulators are now attempting to deliver some clarity through the haze.

Regulators have proposed that people living in New York be allowed to legally cultivate up to six mature marijuana plants — per household. That’s provided you don’t live on a US military base or within federally-subsidized housing, because marijuana is still considered an illegal drug under federal law.

Anyone growing a pot plant must be 21 years of age or older. Also, plants aren’t allowed to be in public view, and adult plants must be purchased from licensed cannabis retailers. Now, the State Cannabis Control Board will vote on the proposed rules. If approved, a 60-day public comment period will take place before the law goes into effect.
