(New York, NY) — There’s an effort underway to dismiss the criminal case involving a Long Island Marine accused in the subway chokehold death of Jordan Neely. The lawyers for Daniel Penny filed a motion Tuesday to get their client’s charges dropped following the fatal chokehold of Neely on a Manhattan train in May. In their motion, Penny’s lawyers cited that several witnesses on the train said they feared for their life at the time. Penny pleaded not guilty to manslaughter and negligent homicide charges.
