(New York, NY) – Daniel Penny, the former Marine who allegedly used a deadly chokehold on a mentally unstable homeless man on a subway, has pled not guilty. He’s been charged with manslaughter in relation to the May 1 death of Jordan Neely. Prosecutors say Penny caused Neely’s death by restraining him.
Penny says he was trying to protect himself and fellow riders from Neely, who was allegedly threatening riders on an F train. Although he performed years ago as a Michael Jackson impersonator within the subways, Penny also had a long arrest record – including for violent incidents.
