(New York, NY) — Former Marine Daniel Penny, who has been charged with killing homeless man Jordan Neely on the subway last month, is speaking out for the first time on the Law and Crime Network. The 24-year-old Penny says he held Neely down to protect others on the subway, after Neely threatened riders. Penny tells the Law and Crime Network that he did not see color when he put Neely in a chokehold in May aboard an F Train. Neely was black. The East Village resident says he was hoping cops would arrive soon to help him, and he says the chokehold only last five minutes, not fifteen as reported in the press. Penny has been charged with manslaughter He is due back in court on July 17th.
