KEW GARDENS, Queens – A man in Queens has been hit with illegal gun charges after he shot and killed a man who allegedly tried to rob him—but so far he hasn’t been charged with murder. Police say the shooting happened in a driveway on 82nd Avenue in Kew Gardens at around 2 a.m. Wednesday.
Investigators say a 32-year-old man was armed with a sharp object which turned out to be a pen, and allegedly continued to approach the man for money and cigarettes.
They say thats when 65-year-old, Charles Foehner, fired a gun shooting multiple times–killing the man.
The Queens D-A hasn’t yet decided if he should be charged with murder.
The 65-year-old was charged with second-degree criminal possession of a weapon, and criminal possession of a firearm.
