A Man Charged with Manslaughter in a Fatal Subway Shove

QUEENS, N.Y. (77WABC) — On Tuesday October 18, officers from the 110 Precinct in Queens arrested and charged 50-year-old Carlos Garcia of  114-20 133 Street
in Queens, NY with Manslaughter.

Garcia allegedly shoved 48-year-old Heriberto Quintana of  89-24 164 Street in Queens  at the 74th Street train station after Quintana accidentally bumped Garcia. Police say the bump caused Garcia to drop his cellphone onto the subway tracks.

Quintana refused to go onto the tracks to retrieve the phone and a scuffle ensued. It was during the scuffle that Quintana was fatally pushed onto the tracks and struck by an oncoming “F” train on the northbound platform.

The victim was removed from under the train with severe trauma to the body and transported by EMS to Elmhurst Hospital where he was pronounced dead.

The investigation is ongoing.
