NEW YORK (77WABC) — Another instance of catch and release.

31-year-old Michael Palacios — an axe-wielding Man rejected by a woman at the McDonalds on Delancey Street in the Lower East Side — was recorded tearing up the establishment in a fit of rage on Friday after he was rebuffed.

According to the Manhattan District Attorney’s office, Palacios was released after his arraignment on fourth-degree criminal-mischief and possession-of-weapons charges hours. Neither charge is eligible for bail under the state’s lenient criminal justice reforms.

According to a criminal complaint, Palacios allegedly slammed two tables and a plate-glass partition during the early-morning rampage. Cell phone video of the incident shows three men at the McDonald’s intervening by throwing punches at him while he appeared to remain calm.

Palacios has one prior bust for resisting arrest.
