Wayne, NJ (77WABC) Wayne Police say a man who appeared to be under the influence of alcohol allegedly choked a female Burger King employee during a dispute over wearing a facemask. The man fled the Rt. 23 South burger King after the incident. Police say they captured the suspect, David Sivertsen, nearby on a driveway on the Newark-Pompton Turnpike. Police say Silvertsen said “you got me,” as officers approached. They say he was agitated and appeared to be under the influence of alcohol.
Police say the man intentionally slammed his head against a bench during processing while he was handcuffed. Silvertsen was taken to a nearby hospital. After being treated and released from the hospital he was remanded to the Passic County Jail pending a hearing.
Silvertsen is charged with aggravated assault.
Police say the dispute erupted around 4 pm Saturday afternoon. Video from the restaurant shows the confrontation.
